Kelly refused Wednesday to block President Trump’s appointment of White House Budget Director Mick Mulvaney to head the CFPB. That request had been made by Leandra English, who was appointed acting head of the Bureau by former CFPB Director Richard Cordray after he announced his retirement in November 2017. English had previously served as Cordray’s chief of staff. When President Trump then appointed outspoken CFPB critic Mulvaney to head the organization, the stage was set for turmoil and controversy in the months to come. With both Mulvaney and English arguing that they were the legitimate Acting Director of the Bureau, English filed a lawsuit seeking a temporary restraining order. At the time even the CFPB’s own general counsel said the law was on the President’s side, but it was clear that a protracted legal battle lay ahead.Judge Kelly said that English had failed to meet the “exacting standard” necessary for him to issue a preliminary injunction, adding that he saw nothing the CFPB’s designation as an independent bureau that would dictate who could serve as acting director. In his written opinion, Judge Kelly said, “The president has designated Mulvaney the CFPB’s acting director, the CFPB has recognized him as the acting director, and it is operating with him as the acting director. Granting English an injunction would not bring about more clarity; it would only serve to muddy the waters.”English’s argument hinges upon the notion that the CFPB was intended to be an independent agency, and cites the 2010 Dodd-Frank Act, which created the agency. President Trump’s case cites the 1998 Federal Vacancies Reform Act to support the administration’s position. In his written opinion, Judge Kelly said, “The best reading of the two statutes is that Dodd-Frank requires that the deputy director ‘shall’ serve as acting director, but that under the FVRA the president ‘may’ override that default rule.”Department of Justice spokeswoman Lauren Ehrsam told Law360, “We are pleased the court vindicated the President’s authority to appoint Mick Mulvaney as Acting Director of CFPB, finding that Ms. English had not shown a substantial likelihood of success on the merits, and is unlikely to suffer irreparable harm.”Deepak Gupta of Gupta Wessler PLLC, an attorney who is representing English, said on Twitter Wednesday night that, “The law is clear: President Trump may not circumvent the Senate confirmation process by installing his White House budget director to run the CFPB part time. Mr. Mulvaney’s appointment undermines the bureau’s independence and threatens its mission to protect American consumers.” Sign up for DS News Daily Share Save Print This Post The Best Markets For Residential Property Investors 2 days ago Subscribe About Author: David Wharton The Week Ahead: Nearing the Forbearance Exit 2 days ago The Best Markets For Residential Property Investors 2 days ago Servicers Navigate the Post-Pandemic World 2 days ago Demand Propels Home Prices Upward 2 days ago Governmental Measures Target Expanded Access to Affordable Housing 2 days ago Data Provider Black Knight to Acquire Top of Mind 2 days ago Home / Daily Dose / District Judge Sides With President Trump on CFPB Director Demand Propels Home Prices Upward 2 days ago in Daily Dose, Featured, Government, Journal, News Previous: Disaster Playbook Next: The Industry Pulse Tagged with: CFPB cfpb acting director Consumer Financial Protection Bureau leandra english Mick Mulvaney Richard Cordray January 11, 2018 1,855 Views Servicers Navigate the Post-Pandemic World 2 days ago

The suit is the latest in a chain of class-action complaints filed against retailers and restaurant companies, such as Arby’s, Wendy’s, Home Depot and Target. The complaint alleges the breach compromised names, credit and debit card numbers, card expiration dates, card verification values and other information of Chipotle customers nationwide. It also said the breach forced credit union and other financial institutions to cancel or reissue cards, close accounts, stop payments, block transactions, issue refunds, increase fraud monitoring efforts and deal with cardholder complaints and confusion. Credit unions and financial institutions also lost interest and transaction fees due to reduced card usage, and the cards and their corresponding account numbers became worthless, it added.“Though an investigation is still ongoing, it appears that hundreds of thousands of defendant’s customers at locations nationwide have had their credit and debit numbers compromised, have had their privacy rights violated, have been exposed to the risk of fraud and identify theft, and have otherwise suffered damages,” the complaint alleged. 21SHARESShareShareSharePrintMailGooglePinterestDiggRedditStumbleuponDeliciousBufferTumblr
Ryanair is, as it says Zadarski.hr, confirmed that his planned summer base in Zadar was canceled due to the deteriorating situation with the COVID-19 virus and increased travel bans. “Ryanair announced that due to the situation with the corona virus, unfortunately, flights on certain routes will be canceled in April. About 150 flights to several destinations were canceled. “Most canceled flights are from Dublin, London, Brussels and Stockholm, while some routes such as Vienna, Prague, Gothenburg, Dusseldorf and Karlsruhe are on schedule according to the planned flight schedule in late March and early April,” he told Zadarski.hr spokesman for Zadar airport Nikola Barać. Let us remind you, Lauda or Laudamotion was supposed to manage the base in Zadar on behalf of Ryanair from this year, but now the plan has been postponed until the summer of 2021. Ryanair regrets that this decision will result in a series of canceled flights. All affected passengers received email cancellation notifications. Passengers concerned will be able to choose between a full refund or a travel credit that can be used on Ryanair flights over the next 12 months, the official statement said. Ryanair, they say, continues to fully adhere to WHO and national government guidelines for travel bans. The situation changes daily and all passengers on flights affected by travel bans or cancellations receive an email and are offered flight replacements, a full refund or travel bonuses. The season of international flights begins when Ryanair’s summer flight schedule for Zemunik, which was supposed to start on March 29. This year, they announced connections with as many as 32 destinations, of which a total of 12 are new lines. The effect of the canceled flights on the traffic of Zadar Airport will be around 25.000 incoming passengers or about 50 percent of the traffic in April, Barać estimated the losses that Zadar airport will suffer due to the cancellation of flights.
Achmea concluded that solving these problems would be too expensive and that it would instead refocus on company pension funds, non-mandatory sector schemes, occupational pension funds as well as the general pension fund (APF) of its subsidiary, insurer Centraal Beheer. The company said it would keep the name Syntrus Achmea for the time it would take to guide the departing sector schemes “to the exit”.All pension funds involved have found a new administrator.Achmea introduced the name Syntrus – a combination of the words “synergy” and “trust” – in 2008, when PVF Achmea and Interpolis merged. It had already abolished the name Syntrus at its asset management branch in 2016, when Syntrus Achmea Asset Management was swallowed up by Achmea Investment Management.Achmea made clear that its property management subsidiary Syntrus Achmea Real Estate & Finance (SAREF) would keep its name. Dutch co-operative financial group Achmea has changed the name of its subsidiary for pensions provision from Syntrus to Achmea Pension Services, it has announced.A spokesman explained that the decision was partly meant to improve the subsidiary’s reputation – which had incurred some “dents” – and that the new name indicated a repositioning with a focus on innovative digital services. At the end of 2016, Syntrus Achmea announced that it would cease services to mandatory industry-wide pension funds in the Netherlands. At the time, it indicated that its new IT system could not cope with the multitude of the sector scheme arrangements. Many sector schemes had left Syntrus Achmea following prolonged IT problems.

The hockey stick is a growth chart that shows some inflection point at which revenue goes up at an extremely high angle and continues in that direction forever.I’ve seen sales plans and projections that show a hockey stick for the future sales, even though there is no plan or data to support that kind of growth can be achieved, other than some data that points to the size of the market. When a company buys another company, they often buy a hockey stick chart that shows them how much revenue and profitability is going to grow, providing them with belief that their investment is going to grow, and showing them how they can very easily profit from their investment in a short period. But, the hockey stick eludes those who don’t understand what it takes to make revenue and profit grow. Reality intervenes, mocking them and their hockey stick chart. The chart in no way reflects what it really takes to produce those results. It is incredibly difficult to build a high-performing sales organization. Most people underestimate the amount of time, money, and energy required. Especially how much energy is required from leadership.Lots of companies lose focus because they get tied down in the day-to-day operational problems that plague every company. Their attention shifts away from client acquisition, order acquisition, and creating new revenue. Their energy is consumed by compliance, regulatory issues, and a list of other problems that have nothing to do with client acquisition and growth. The hockey stick chart comes only when you are firing on all cylinders, winning new clients, while retaining your existing clients and growing your wallet share. You have to get a lot of things right.Wanting growth isn’t the same as being motivated and driven to do what it takes to grow. You bring to life only what you focus on.If you bought the hockey stick chart, frame it and hang it on your wall. A picture is what you really bought. If you want results that look like a hockey stick, you are going to have to dig in and build a high-performing sales organization. Get the Free eBook! Want to master cold calling?
